JOB STATEMENT
In this role the Legal Counsel contributes to all project and service-related contract commercial issues starting from proposal planning and preparation, involving country specific experience in legal, finance and tax related issues.
Effective support to sales is offered by leading or contributing to contract negotiations with clients and clarifying interfaces between technical and commercial contract provisions. Non-disclosure and Confidentiality agreements, as well as involvement of subcontractors and suppliers, and transferring relevant contractual elements to procurement, and other service departments within the business is a part of the responsibility area of the Legal Department.
Legal Counsel supports in claim avoidance and opportunity management, until the end of contract liabilities.
JOB DUTIES AND RESPONSIBILITIES
Provide general legal and contractual support to Market Area Africa
Support contract drafting, vetting and negotiations and follow-up until effective
Provide input to service proposals, purchase orders, order confirmations and other contractual documents.
Support business in all project-related contractual and commercial issues from proposal planning, proposal preparation and contract negotiations through effectiveness and support contract execution until end of contract liabilities.
Facilitate Risk Assessments and contribute to service sales case presentations.
Make available templates, checklists, and other tools for service business.
Perform training on relevant legislative and contractual topics.
Assist and guide in service delivery, claim management, insurance topics, trade compliance etc.
Support business with compliance related matters relevant to the Market Area
Support contract management and administration as well as contribute to continuous improvement activities within the legal function
QUALIFICATIONS AND EXPERIENCE
Matric (Garde 12)
South African legally qualified attorney with 3+ years post admission as an Attorney of the High Court of South Africa
LLB degree or equivalent legal qualification
Solid commercial and legal knowledge
2 years of experience in contract/ commercial/ corporate law
Experience in the drafting, vetting, negotiation and commercial execution of long-term service agreements
Basic knowledge of NEC and FIDIC contracts as well as dealing with parastatals
Experience working in an international environment and/or multi-national organisation would be advantageous

Reports Directly to the Director, Legal - Africa

Various internal stakeholders, business areas and service departments within the business
SKILLS AND ABILITIES
Risk management skills
Good service business acumen and excellent interpersonal and negotiation skills.
Ability to explain complex topics in a simple way
Ability to handle complex situations and transactions with little to no supervision
Good command of the English language being fluent in oral and written English
Willingness to travel internationally and to other African Countries
Pragmatic way of working - solutions driven with a flexible, proactive, problem-solving approach
